This Seller Agreement (“Agreement”) is entered into between Luxe Loom (“Platform”, “We”, “Us”) and the Seller (“You”, “Seller”) who registers and sells products through the Luxe Loom platform.
By registering as a seller on Luxe Loom, you agree to comply with the following terms and conditions.
1. Platform Role
- Luxe Loom is an online marketplace that connects sellers and customers.
- Luxe Loom does not own, manufacture, or physically handle products unless clearly stated.
2. Seller Eligibility
To sell on Luxe Loom, the Seller must:
- Provide accurate personal and business information
- Be legally permitted to sell products in Sri Lanka
- Ensure products comply with Sri Lankan laws and regulations
3. Commission Structure
- Luxe Loom charges a 10% commission on every successful sale made through the platform.
- The commission is calculated based on the final selling price of the product.
- Commission will be automatically deducted before releasing seller payouts.
4. Payments & Payouts
- Seller payments will be processed after deducting the applicable commission.
- Payout schedules (weekly/monthly) will be determined by Luxe Loom.
- Luxe Loom is not responsible for delays caused by banks or payment gateways.
5. Seller Responsibilities
The Seller agrees to:
- Provide accurate product descriptions and pricing
- Ensure product quality and authenticity
- Deliver orders within the promised timeframe
- Handle customer inquiries professionally
- Comply with all applicable laws and regulations
6. Prohibited Activities
The Seller must not:
- Sell counterfeit, illegal, or prohibited items
- Upload misleading product information
- Engage in fraudulent transactions or fake orders
- Manipulate pricing or reviews
7. Order Fulfillment & Delivery
- Sellers are responsible for packaging and dispatching orders correctly.
- Any delays or damages caused during seller handling are the seller’s responsibility.
8. Returns & Refunds
- Return and refund decisions depend on the seller’s return policy and product condition.
- Sellers are responsible for refund amounts related to their products.
- Luxe Loom may assist in dispute resolution but is not financially liable.
9. Account Suspension & Termination
Luxe Loom reserves the right to suspend or terminate seller accounts if:
- Fraudulent activity is detected
- Repeated customer complaints occur
- Terms of this Agreement are violated
10. Intellectual Property
- Sellers retain ownership of their product content.
- Luxe Loom retains full ownership of its brand name, platform, and content.
- Unauthorized use of Luxe Loom branding is prohibited.
11. Limitation of Liability
Luxe Loom shall not be liable for:
- Product defects
- Delivery failures caused by sellers or third parties
- Losses arising from seller misconduct
12. Indemnification
The Seller agrees to indemnify and hold Luxe Loom harmless from any claims, losses, or damages arising from:
- Product issues
- Legal violations
- Seller negligence or misconduct
13. Amendments
Luxe Loom may update this Agreement at any time. Continued use of the platform indicates acceptance of the updated terms.
14. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of Sri Lanka.
